TOPIC IN BRIEF:

Taylor v Killer Queen LLC [2026] HCA 5 (the Katy Perry trade mark proceeding) is the High Court’s first detailed consideration of section 60 of the Trade Marks Act 1995 (Cth). In this session, Sam Hallahan (who appeared in the High Court for the respondents, led by Matthew Darke SC and Emma Bathurst) will discuss what the High Court said about various aspects of s 60, how the section was applied, and how the decision might affect s 60 oppositions in the future.

Sam Hallahan is a barrister at the NSW bar practising in intellectual property litigation and general commercial litigation. He has appeared in notable trade mark cases such as Anchorage Capital and Trident Seafoods. He is recognised as a leading junior in IP by Chambers & Partners, Doyle’s Guide and Legal500.
