David is a partner of Corrs in Perth, with a team specialising in technology acquisition and governance; cyber resilience; data governance and management; intellectual property enforcement, transactions and governance; and, competition law enforcement and investigations.
 TOPIC: An overview of the legal and governance issues associated with data management, including:

  • Corporate risk and responsibility in the context of cyber security (director’s duties, contractual obligations, the risk of claims for negligence and potential class actions) and the importance of cyber resilience governance to manage this risk.
  • The applicable legal framework in which data governance structures must be formulated:
    • Australian legislation, including privacy laws, evidence laws, data sharing laws and the My Health Record scheme; and
    • EU GDPR and how it can affect Australian businesses.
  • Proposals for change, including the Productivity Commission’s report into data availability and use (and some other ideas for legal development).
