|TOPIC||Delay – The Last Fatal Mistake
Whether you are a client, a patent or trade mark attorney, a solicitor, a barrister or even a decision-maker there is only one mistake in litigation. That mistake is to delay. Almost without exception all other mistakes, errors in procedure, errors of substantive law can be fixed (albeit with cost implications). The only error that is fatal is delay. This paper will address the incidents of delay and how they effect in particular intellectual property litigation. The paper will particularly focus on delay involving patent and trade mark issues”.

Andrew was first admitted to practice as a solicitor in 1991, Andrew holds a Bachelor of Arts and a Bachelor of Law from the University of Queensland and a Masters of Law and Post Graduate Diploma in Communications from the Queensland University of Technology.Andrew’s practice involves advising work and dispute resolution relating to intellectual property and confidential information. Andrew appears in IP Australia and the State and Federal Courts in connection with trade marks, copyright and patents. Andrew also advised on and litigates issues concerning confidential information, ITC and domain name disputes. He has advised on and litigated matters pursuant to the auDA and the UDRP dispute resolution protocols.
